A Refugee Visa is part of Australia’s Humanitarian Program and is for people who are outside Australia and are unable to return to their home country because they fear serious harm or persecution.

Refugee visas are usually applied for offshore, which means the applicant must be outside Australia at the time the application is lodged and when the visa is decided. Many applicants are referred to Australia through the United Nations High Commissioner for Refugees or apply under Australia’s offshore humanitarian program.
To be eligible for a Refugee Visa, an applicant must demonstrate a well-founded fear of persecution in their home country due to their race, religion, nationality, political opinion, or membership of a particular social group. The applicant must also show that their home country is unable or unwilling to provide protection.
If granted, a Refugee Visa is a permanent visa. It allows the holder to live, work, and study in Australia permanently. Refugee visa holders may access Medicare, social security benefits, and settlement support services, and may apply for Australian citizenship in the future if eligibility requirements are met.
A Refugee Visa is different from a Protection Visa. Refugee visas are for people outside Australia, while Protection Visas (subclass 866) are for people who are already in Australia and seeking protection.
People who are currently in Australia, including those who have overstayed their visa or are in immigration detention, generally cannot apply for a Refugee Visa. In these situations, a Protection Visa may be the appropriate option, depending on individual circumstances.
