Protection Visa
(Subclass 866)
A Protection visa is for people who arrived in Australia on a valid visa and wish to seek asylum. The Protection visa is a permanent visa. It allows you to live, work, and study in Australia permanently. You may access government services such as Medicare and Centrelink and sponsor eligible family members for permanent residence through the offshore Humanitarian Program. You may also travel to and from Australia for up to five years.
Members of the same family unit may apply together in the same application. All applicants must be in Australia at the time of application. Members of the same family unit include a spouse or de facto partner, a dependent child or step-child, a dependent child or step-child of the family head’s partner, and other dependent relatives of the family head.

You cannot make a valid application for this visa if you are an unauthorised maritime arrival. Under the Migration Act 1958, to engage Australia’s protection obligations, you must be a refugee or meet the complementary protection criteria. Australia must not return a person to their home country if there is a real risk that the person would suffer serious harm.

At the first free consultation, after checking your visa status and conditions, we will assess whether you are eligible to apply for a visa.
